USITC Makes Determinations in Five-Year (Sunset) Review Concerning Light-Walled Rectangular Pipe from Taiwan

The U.S. International Trade Commission (USITC) today determined that revoking the existing antidumping duty order on light-walled rectangular pipe and tube from Taiwan would be likely to lead to continuation or recurrence of material injury within a reasonably foreseeable time.

As a result of the Commission's affirmative determination, the existing order on imports of these products from Taiwan will remain in place.

All six Commissioners voted in the affirmative.

Today's action comes under the five-year (sunset) review process required by the Uruguay Round Agreements Act. See the attached page for background on this five-year (sunset) review.

BACKGROUND

The Uruguay Round Agreements Act requires the Department of Commerce to revoke an antidumping or countervailing duty order, or terminate a suspension agreement, after five years unless the Department of Commerce and the USITC determine that revoking the order or terminating the suspension agreement would be likely to lead to continuation or recurrence of dumping or subsidies (Commerce) and of material injury (USITC) within a reasonably foreseeable time.

The Commission's institution notice in five-year reviews requests that interested parties file responses with the Commission concerning the likely effects of revoking the order under review as well as other information. Generally within 95 days from institution, the Commission will determine whether the responses it has received reflect an adequate or inadequate level of interest in a full review. If responses to the USITC's notice of institution are adequate, or if other circumstances warrant a full review, the Commission conducts a full review, which includes a public hearing and issuance of questionnaires.

The Commission generally does not hold a hearing or conduct further investigative activities in expedited reviews. Commissioners base their injury determination in expedited reviews on the facts available, including the Commission's prior injury and review determinations, responses received to its notice of institution, data collected by staff in connection with the review, and information provided by the Department of Commerce.

The five-year (sunset) review concerning Light-Walled Rectangular Pipe and Tube from Taiwan was instituted on July 1, 2011.

On October 4, 2011, the Commission voted to conduct an expedited review. Chairman Deanna Tanner Okun, Vice Chairman Irving A. Williamson, and Commissioners Daniel R. Pearson, Shara L. Aranoff, and Dean A. Pinkert found that the domestic group response was adequate and the respondent group response was inadequate and voted for an expedited review. Then-Commissioner Charlotte R. Lane found that the domestic group response was adequate and the respondent group response was inadequate but that circumstances warranted a full review.

USITC Will Expedite Five-Year (Sunset) Review Concerning Sodium Hexametaphosphate from China

The U.S. International Trade Commission (USITC or Commission) has voted to expedite its five-year ("sunset") review concerning the antidumping duty order on sodium hexametaphosphate from China (Inv. No. 731-TA-1110 (Review)).

As a result of this vote, the Commission will conduct an expedited review to determine whether revocation of this order would be likely to lead to continuation or recurrence of material injury within a reasonably foreseeable time.

USITC Votes to Continue Case on Diffusion-Annealed, Nickel-Plated Flat-Rolled Steel Products from Japan

 

USITC VOTES TO CONTINUE CASE ON DIFFUSION-ANNEALED, NICKEL-PLATED FLAT-ROLLED STEEL PRODUCTS FROM JAPAN

 

The United States International Trade Commission (USITC) today determined that there is a reasonable indication that a U.S. industry is materially injured by reason of imports of diffusion-annealed, nickel-plated flat-rolled steel products from Japan that are allegedly sold in the United States at less than fair value.

Chairman Irving A. Williamson and Commissioners Shara L. Aranoff, Dean A. Pinkert, David S. Johanson, and Meredith M. Broadbent voted in the affirmative. Commissioner Daniel R. Pearson voted in the negative.

As a result of the Commission's affirmative determination, the U.S. Department of Commerce will continue to conduct its investigation on imports of these products, with its preliminary antidumping duty determination due on or about September 3, 2013.

Diffusion-Annealed, Nickel-Plated Flat-Rolled Steel Products from Japan

Product Description: Diffusion-annealed, nickel-plated steel is a flat-rolled steel product, plated or coated with nickel or with a nickel-based alloy and subsequently annealed. Annealing after nickel-plating causes the formation of a thin layer of iron-nickel alloy between the steel substrate and the nickel coating, which prevents the nickel coating from flaking or separating from the substrate during fabrication operations. The principal application for diffusion-annealed, nickel-plated steel is for the fabrication of cans and end caps of alkaline and lithium batteries. Diffusion-annealed, nickel-plated steel is also used for the manufacture of fuel, power-steering, and other automotive fluid lines.

USITC Releases Fourth Annual Report on U.S. Textile and Apparel Imports from China

The U.S. International Trade Commission (USITC) today released its annual compilation of bi-weekly reports on textile and apparel imports from China.

The report, Textile and Apparel Imports from China: Statistical Reports, Annual Compilation 2012, was requested by the U.S. House of Representatives' Committee on Ways and Means.

As requested, the USITC, an independent, nonpartisan, factfinding federal agency, produced an annual compilation of data that has been posted on a bi-weekly basis on the USITC website. The data in the report are shown on an annual and quarterly basis, by category and by Harmonized Tariff Schedule (HTS) 10-digit subheadings.

By category, annual data are provided from 2006 through 2012, and quarterly data are provided from first quarter 2011 through fourth quarter 2012. By HTS10 subheading, annual data are provided from 2010 through 2012, and quarterly data are provided from first quarter 2011 through fourth quarter 2012.

USITC Releases Report on Likely Effects of Duty-Free Entry for Goods Under the GSP

The U.S. International Trade Commission (USITC) today released a public version of its confidential report on the probable economic effects of making certain products eligible for duty- free treatment and for waiving the competitive need limit for certain goods under the Generalized System of Preferences (GSP).

The report, Advice Concerning Possible Modifications to the U.S. Generalized System of Preferences, 2012 Review: Additions and Competitive Need Limitation Waivers, was requested by the U.S. Trade Representative (USTR).

The USITC, an independent, nonpartisan, factfinding federal agency, submitted a confidential version of the report to the USTR on April 8, 2013.

As requested, the USITC provided advice as to the impact of the addition of certain products to the list of articles eligible for the GSP.

The reviewed products were: fresh cut sweetheart, spray, and other roses (HTS 0603.11.00, 0603.11.0010, 0603.11.0030, and 0603.11.0060); vegetables not elsewhere specific or included, uncooked or cooked by steaming or boiling in water, frozen, reduced in size (HTS 0710.80.97) or the 3 existing 10 digit lines for broccoli (HTS 0710.80.9722, 0710.80.9724, and 0710.80.9726); artichokes, prepared or preserved otherwise than by vinegar or acetic acid, and not frozen (HTS 2005.99.80); and refined copper wire less than 6 mm in diameter (HTS 7408.19.0030).

The USITC also provided advice, as requested, as to the effect on U.S. industries, imports, and consumers of granting a waiver of the competitive need limit for Brazil for imports of calcium silicon ferroalloys (HTS 7202.99.20).

"Competitive need limitations" (CNLs) set the maximum U.S. import level for GSP eligibility and are based on the dollar value or share of total imports of a given product. Once the limit is reached, trade is considered "competitive," benefits are no longer needed, and imports of the article become ineligible for GSP treatment, unless a waiver is granted.

The USTR published full article descriptions of a number of products for which CNL waiver petitions had been filed in the Federal Register (77FR249) on December 28, 2012. The USTR subsequently notified the USITC that petitions requesting CNL waivers for all but calcium-silicon imports from Brazil had been withdrawn, and the USITC revised the scope of its investigation accordingly.

The U.S. International Trade Commission (USITC or Commission) has voted to conduct full five-year ("sunset") reviews concerning the countervailing duty orders on hot-rolled steel products from India, Indonesia, and Thailand and the antidumping duty orders on hot-rolled steel products from China, India, Indonesia, Taiwan, Thailand, and Ukraine (Inv. Nos. 701-TA-405, 406, & 408 and 731-TA-899-901 & 906-908 (Second Review)).

The United States International Trade Commission (USITC) today determined that there is a reasonable indication that a U.S. industry is materially injured by reason of imports of frozen warmwater shrimp from China, Ecuador, India, Indonesia, Malaysia, Thailand, and Vietnam that are allegedly subsidized.

Product Description: Certain frozen warmwater shrimp and prawns, whether wild-caught (ocean harvested) or farm-raised (produced by aquaculture), head-on or head-off, shell-on or peeled, tail-on or tail-off, deveined or not deveined, cooked or raw, or otherwise processed in frozen form, regardless of size. The products described may be processed from any species of warmwater shrimp and prawns. Frozen shrimp and prawns that are packed with marinade, spices or sauce are included in the scope. In addition, food preparations (including dusted shrimp), which are not "prepared meals," that contain more than 20 percent by weight of shrimp or prawn are also included in the scope. Excluded from the scope are: (1) breaded shrimp and prawns; (2) shrimp and prawns generally classified in the Pandalidae family and commonly referred to as coldwater shrimp, in any state of processing; (3) fresh shrimp and prawns whether shell-on or peeled; (4) shrimp and prawns in prepared meals; (5) dried shrimp and prawns; (6) canned warmwater shrimp and prawns; and (7) certain "battered shrimp." The predominant end-use for warmwater shrimp and prawns is human consumption.

The U.S. International Trade Commission (USITC) today determined that revoking the existing antidumping duty order on certain activated carbon from China would be likely to lead to continuation or recurrence of material injury within a reasonably foreseeable time.

As a result of the Commission's affirmative determination, the existing order on imports of this product from China will remain in place.

All six Commissioners voted in the affirmative.

USITC Makes Determinations in its Five-Year (Sunset) Reviews Concerning Corrosion-Resistant Carbon Steel Flat Products from Germany and Korea

The U.S. International Trade Commission (USITC) today determined that revoking the existing countervailing duty order on corrosion-resistant carbon steel flat products from Korea and the existing antidumping duty orders on this product from Germany and Korea would not be likely to lead to continuation or recurrence of material injury within a reasonably foreseeable time.

As a result of the Commission's negative determinations, the existing orders on imports of this product from Germany and Korea will be revoked.

All six Commissioners voted in the negative.

Today's action comes under the five-year (sunset) review process required by the Uruguay Round Agreements Act. See the attached page for background on these five-year (sunset) reviews.

BACKGROUND

The Uruguay Round Agreements Act requires the Department of Commerce to revoke an antidumping or countervailing duty order, or terminate a suspension agreement, after five years unless the Department of Commerce and the USITC determine that revoking the order or terminating the suspension agreement would be likely to lead to continuation or recurrence of dumping or subsidies (Commerce) and of material injury (USITC) within a reasonably foreseeable time.

The Commission's institution notice in five-year reviews requests that interested parties file responses with the Commission concerning the likely effects of revoking the order under review as well as other information. Generally within 95 days from institution, the Commission will determine whether the responses it has received reflect an adequate or inadequate level of interest in a full review.
