USITC Institutes Section 337 Investigation of Certain Cellular Base Station Communication Equipment, Components Thereof, and Products Containing Same

The U.S. International Trade Commission (USITC) has voted to institute an investigation of certain cellular base station communication equipment, components thereof, and products containing same.  The products at issue in the investigation are described in the Commission’s notice of investigation

The investigation is based on a complaint filed by Apple, Inc. of Cupertino, CA, on January 19, 2022.  The complaint alleges violations of section 337 of the Tariff Act of 1930 in the importation into the United States and sale of certain cellular base station communication equipment, components thereof, and products containing same.  The complainant requests that the USITC issue a limited exclusion order and a permanent cease and desist order.  

The USITC has identified the following as the respondents this investigation:

Ericsson AB, of Kista, Stockholm, Sweden; 
Telefonaktiebolaget LM Ericsson, of Kista, Stockholm, Sweden; and
Ericsson Inc., of Plano, TX.

By instituting this investigation (337-TA-1302), the USITC has not yet made any decision on the merits of the case.  The USITC’s Chief Administrative Law Judge will assign the case to one of the USITC’s administrative law judges (ALJ), who will schedule and hold an evidentiary hearing.  The ALJ will make an initial determination as to whether there is a violation of section 337; that initial determination is subject to review by the Commission. 

The USITC will make a final determination in the investigation at the earliest practicable time.  Within 45 days after institution of the investigation, the USITC will set a target date for completing the investigation.  USITC remedial orders in section 337 cases are effective when issued and become final 60 days after issuance unless disapproved for policy reasons by the U.S. Trade Representative within that 60-day period.

The U.S. International Trade Commission (USITC) has voted to institute an investigation certain of mobile phones and tablet computers, all with switchable connectivity.  The products at issue in the investigation are described in the Commission’s notice of investigation.

The investigation is based on a complaint filed by Ericsson Inc. of Plano, TX and Telefonaktiebolaget LM Ericsson of Kista, Stockholm, Sweden, on January 18, 2022.  The complaint alleges violations of section 337 of the Tariff Act of 1930 in the importation into the United States and sale of mobile phones and table computers, all with switchable connectivity, and products containing same.  The complainants request that the USITC issue a limited exclusion order and a permanent cease and desist order.

The U.S. International Trade Commission (USITC) has voted to institute an investigation of certain wireless standard compliant electronic devices, including communication devices and tablet computers.  The products at issue in the investigation are certain wireless standard compliant devices including communication devices and tablet computers, including certain Apple iPhones, iPads, and other cellular-enabled products that use the 2G GSM and 4G LTE telecommunications standards.

The investigation is based on a complaint filed by Ericsson Inc., of Plano, TX, and Telefonaktiebolaget LM Ericsson of Stockholm, Sweden, on February 26, 2015.  The complaint alleges violations of section 337 of the Tariff Act of 1930 in the importation into the United States and sale of certain wireless standard compliant electronic devices, including communication devices and tablet computers that infringe patents asserted by the complainants.  The complainants request that the USITC issue a limited exclusion order and a cease and desist order.

The USITC has identified Apple, Inc., a/k/a Apple Computer, Inc., of Cupertino, CA, as the respondent in this investigation.

USITC Institutes Section 337 Investigation of Certain Wireless Communications Base Stations and Components Thereof

The U.S. International Trade Commission (USITC) has voted to institute an investigation of certain wireless communications base stations and components thereof. The products at issue in this investigation are wireless communications base stations and components thereof for use with next-generation wireless-communication technologies such as 4G LTE.

The investigation is based on a complaint filed by Adaptix, Inc., of Carrolton, TX, on January 24, 2013. The complaint alleges violations of section 337 of the Tariff Act of 1930 in the importation into the United States and sale of certain wireless communications base stations and components thereof that infringe a patent asserted by Adaptix, Inc. The complainant requests that the USITC issue an exclusion order and cease and desist orders.

The USITC has identified the following as respondents in this investigation:

Telefonaktiebolaget LM Ericsson of Stockholm, Sweden; and
Ericsson Inc. of Plano, TX.

By instituting this investigation (337-TA-871), the USITC has not yet made any decision on the merits of the case. The USITC's Chief Administrative Law Judge will assign the case to one of the USITC's six administrative law judges (ALJ), who will schedule and hold an evidentiary hearing. The ALJ will make an initial determination as to whether there is a violation of section 337; that initial determination is subject to review by the Commission.
