On October 14, 2016, the U.S. International Trade Commission began accepting petitions seeking temporary duty suspensions and reductions in accordance with the American Manufacturing Competitiveness Act of 2016 (AMCA). (See this article for background.)
Commission staff members have noticed that many of the petitions filed to date contain article descriptions that are deficient and that may not be administrable by U.S. Customs and Border Protection.
The only way for petitioners to modify a deficient article description is to withdraw the original petition and file a new petition that contains the corrected article description. This must be done by the December 12 filing deadline. Therefore, as the deadline for filing MTB petitions draws closer, it is imperative that filers understand how to write an article description.
